Please read these terms and conditions carefully. They set out the obligations on Thoroughbred Tracking Online Pty Ltd ("TTOL") and you the customer, under which the Interactive Services are offered online through its web sites www.bloodhound.net.au and www.bloodline.com.au.
By using any of the Interactive Services and/or the site you agree you have read and accept these Terms and Conditions and that they shall apply to your use. This agreement is made between you and Thoroughbred Tracking Online Pty Ltd (ABN 34 097 053 319) whose Registered Office is 739 Mt Alexander Road, Moonee Ponds, 3039, Australia. Bloodline and Bloodhound are registered names of TTOL.
Definitions
In these terms and conditions, the following terms shall have the following meanings:
"Thoroughbred Tracking Online Pty Ltd (Bloodline and Bloodhound)" means the websites operated by Thoroughbred Tracking Online Pty Ltd ("TTOL")
"Interactive Services" means the services made available for Internet access to the subscriber.
The Interactive Services may include services which are operated by third parties and where you may be asked to supply information to these third parties, it will be subject to any terms and conditions that this third party shall require. So any dealings with these third parties shall be considered to be directly with these third parties and not with TTOL.
"Subscriber" means the person described on the Subscription Application Form and in whose name a User Name and a Password are issued.
Payment
TTOL may make available to you commercial and/or other transactional services including, without limitation, the supply of goods and/or services for which a charge may or may not be incurred.
Access to the site is currently made available by registering only. You agree to pay any applicable fees at the rates in effect when a charge is incurred and for this purpose will either:
deposit with "TTOL" or its appointed agent prior to your use of the service the minimum amount specified by "TTOL". "TTOL" will then be entitled to charge any fees or charges incurred by you the Subscriber against this advance payment; or
Pay the amount of the charge by credit card using our Payment Gateway
You must provide us with complete and accurate payment information. By submitting credit card details to "TTOL" or its appointed agent, you warrant that you are entitled to purchase the Interactive Services using those payment details. In the case of unauthorised payments TTOL has the right to suspend or terminate your acesss to the Interactive Services. If we do not receive payment authorization or such authorization is subsequently cancelled, we may immediately terminate or suspend your access to the account
There is no specific time limit applying to the use of the Interactive Service on these Terms and Conditions. However TTOL reserves the right to suspend or terminate your access if you breach these terms and conditions.
Availability of the Site and the Interactive Services.
TTOL cannot promise full and error free operation of the Site and/or Inteacative Services. All liability of TTOL, its directors and employees, however arising, for any loss whatsoever arising from your use or inability to use the Site and/or Interactives Services is excluded. Notwithstanding this TTOL will all at times endeavour to provide maximum access to the Site and ensure the accuracy of its services.
Use of the Site and the Interactive Services
The site and the Interactive Services are for personal and non-commercial use only. You may copy electronically or print any of the Interactive Services used.
The intellectual property in all design, text, graphics and other material is owned by TTOL and/or its respective licensors.
The Site and/or the Interactive Services may include links to web sites and/or services owned and/or operated by third parties, These are provided for purely for convenience is is not responsible for the content or your use of these sites. At all times any links which are shown will have been vetted by TTOL for its suitability.
You acknowledge that TTOL is not responsible for notifying Customers of any upgrades in software, customer identification or enhancements to Bloodline.com.
TTOL reserves the right at any time and from time to time to modify, temporarily suspend the Interactive Service with or withour notfiying the discontinuation to Customer.
You understand and agree that processing of complex data, and TTOL reliance on information acquired from and/or licensed from third parties, errors and omissions will occur despite our best endeavours to avoid them.
Thoroughbred Tracking Online's Responsibilities.
Thoroughbred Tracking Online will
allow the subscriber access the the Interactive Service; and
automatically charge all fees against the advance payment made by the Subscriber.
Thoroughbred Tracking Online reserves the right at all times to
allow the subscriber access the the Interactive Service; and
Suspend the Subscriber's access to the Interactive Service without notice, where TTOL is of the opinion the the Subscriber has breached any of the terms contained in this agreement or that such action is appropriate, desirable or neccessary in the reasonable opinion of TTOL.
amend the fees or introduce new fees or amend any of the terms and conditions of this agreement and notiifcation shall be made by posting them on-line. They shall take effect 14 days after the posting is made on the site.
If TTOL is not able to provide the Interactive Services for any reason, and the Subscriber has a current subscription for access to those Interactive Services then TTOL will refund to the Subscriber the value of unused credits. Any such refund shall be made by TTOL to the Subscriber within a reasonable period after the effective date of termination of the agreement between TTOL and the Subscriber concerned.
No credit will be made for Bonus points or bonus dollar equivalents gained from a prepaid subscription
Subscriber Responsibilities.
The Subscriber agrees that
the Subscriber will not reproduce, distribute, publish, copy ,downloador otherwise exploit any Content which is protected by copyright or other intellectual property or similar rights;
the Subscriber will not hack, break into, access, use or attempt to hack, break into, access or use any other parts of TTOL servers, its Contents and/or any data areas for which the Subscriber has not been authorised by TTOL;
this Agreement is personal to you and you may not assign, transfer, lease or delegate all or any of your rights and obligations with the prior consent of TTOL.
The Subscriber hereby agrees to indemnify and to keep TTOL fully and effectively indemnified against any action, liabiloity, cost, claim, loss, damage, proceeding, expense (including legal costs) suffered or incurred by Thoroughbred Tracking Online arising from or which is directly or indirectly related to;
the Subscriber's use of the Interactive Services and any other person's use of the Service where such person was able to access the Interactive Services by using the Subscriber User name and password; and
any breach or non-observance of any term of this Agreement by the Subscriber or any other person where such person was able to access the Interactive Services by using the Subscriber's User Name and password.
Assignment
This agreement shall be personal to you may not assign, transfer, lease or delegate all or any of your rights and obligations with the prior consent of TTOL.
TTOL reserves the righr to assign or transfer all or any of its rights and obligations under this agreement to a third party. In the event of any assignment or transfer you will be notified either by e-mail or notifivation on the site.
Variation of Terms
TTOL reserves the right to vary this Agreement from time to time. Such changes shall be either notified to you by e-mail or posted on the home page of the Site. Changes in this manner shall be deemed to have been accepted if you continue to use the Site and/or the Interactive Services after a period of two weeks from the date of transmission of the e-mail or of posting on the home page of the Site, whichever occurs later.
Notices
Any notices shall, unless otherwise stated, be in writing and shall be given by sending the same by e-mail, post or facsimile transmission to the other party's address, as may be given in writing at any time.
